​Welcome to Celtic Pickleball. These Terms and Conditions govern all sales and purchases made through our website. By placing an order with Celtic Pickleball, you agree to be bound by these terms.

1. Business Information & Contact

• Trader Status: Sole Trader

• VAT Status: Celtic Pickleball is currently not VAT-registered (operating below the statutory Irish VAT registration threshold). Therefore, prices listed on our website are total prices and do not include or add VAT.

 

2. Pricing and Contract Formation

• Price Changes: Prices listed on our website are subject to change without notice prior to contract formation.

• Order Acknowledgement vs. Acceptance: When you place an order, you will receive an automatic email acknowledging receipt of your order. This email is an acknowledgement only and does not constitute legal acceptance of your order.

• Formation of Contract: A legally binding contract between Celtic Pickleball and the customer is formed only when we dispatch the goods and send you a dispatch confirmation email.

• Right to Refuse Orders: We reserve the right to decline or cancel any order prior to dispatch for reasons including, but not limited to: unavailability of stock, errors in product pricing or descriptions, or suspicion of fraudulent activity. If an order is cancelled after payment has been taken, a full refund will be issued immediately.

 

3. Payment

• We accept most major credit cards, debit cards, and approved digital payment methods displayed at checkout.

• Full payment for products and applicable shipping fees is required at the time the order is placed.

 

4. Shipping, Delivery & International Customs

4.1 Dispatch & Delivery Estimates

• We aim to dispatch in-stock orders received by the next business day (excluding Saturdays, Sundays, and public holidays in the Republic of Ireland).

• Orders will generally be dispatched within two (2) business days.

• Delivery times provided at checkout are estimates only. While we make every reasonable effort to ensure timely delivery, Celtic Pickleball is not liable for delays caused by postal or courier services.

4.2 Shipping Rates & Free Shipping

• Shipping charges are calculated based on weight and destination and are clearly displayed during checkout.

• Free Shipping Offer: We offer free standard shipping on paddle orders valued over €150 / £150 shipping to addresses in the Republic of Ireland and Northern Ireland and Great Britain

• Bulk orders may require a custom shipping quote provided by Celtic Pickleball prior to order processing. Please contact us via email or our website if you wish to place a bulk order.

4.3 Back Orders

• If an item is out of stock, we aim to complete backorders within four (4) weeks, taking into account transit and customs clearance time from international suppliers. If we cannot fulfill a backorder within a reasonable time frame, you will be offered a full refund or exchange.

4.4 Passing of Risk & Delivery Responsibility

• In accordance with EU and Irish consumer law, risk of loss or damage to goods passes to you (the customer) only when you, or a third party designated by you (other than the carrier), physical take possession of the goods.

4.5 Customs, Import Duties & Taxes (UK & Non-EU Orders)

• For orders shipped outside the European Union (including Great Britain):

  • Products are sold on a Delivered Duty Unpaid (DDU) basis.

  • You are solely responsible for paying any local import duties, customs charges, clearance fees, or local taxes levied by the destination country.

5. Right of Cancellation & Returns (14-Day Cooling-Off Period)

Under the EU Consumer Rights Directive and Irish Consumer Rights Act 2022, consumer customers in the EU/UK have the right to cancel their purchase without giving a reason.

5.1 Cancellation Window

• You have 14 days to cancel your order, starting from the day you (or a person designated by you) physically receive the goods.

5.2 Return Conditions

• To exercise your right to cancel, you must notify us at info@celticpickleball.com before the 14-day period expires.

• Goods must be returned to us without undue delay and no later than 14 days from the date you notified us of the cancellation.

• Goods must be returned in their original condition and packaging. You are entitled to inspect the goods as you would in a retail shop, but items used beyond basic inspection (e.g., played with on court) cannot be returned under the cooling-off right.

5.3 Return Shipping Costs

• Unless the item is faulty or delivered in error, you are responsible for paying all return postage costs.

• We strongly recommend using a trackable/recorded postal service. You remain responsible for the goods until they safely reach us.

5.4 Promotional Goods & Deductions

• Bundled Items: If the returned item came with free promotional items (e.g., bags, sweatbands, balls), these must also be returned. If not returned, we reserve the right to deduct the retail value of the promotional items from your refund.

• Diminished Value: We reserve the right to make a deduction from your refund for any loss in value of the goods resulting from unnecessary handling by you.

5.5 Refund Processing

• Once we receive the returned goods (or proof that they have been sent back), we will process your refund within 14 days.

• Refunds will include the original purchase price and standard outward delivery charges (if paid). The refund will be issued to the original payment method.

 

6. Faulty, Damaged, or Non-Conforming Goods

6.1 Your Statutory Rights

• Under the Irish Consumer Rights Act 2022, goods supplied must be as described, fit for purpose, and of satisfactory quality.

• If you receive an item that is damaged upon arrival, defective, or incorrect:

  1. Contact us immediately at info@celticpickleball.com with details and photographs of the issue.

  2. We will arrange or reimburse reasonable return postage costs for verified faulty or damaged goods.

  3. Depending on the timing and nature of the fault, you are entitled to a repair, replacement, or full refund.

6.2 Inspection Upon Delivery

• Please inspect parcels upon receipt. If a outer shipping box arrives visibly severely damaged, you may refuse delivery or note the damage with the carrier when signing. Please notify us immediately so we can assist you.

 

7. Commercial Warranty Statement

• 60-Day Limited Warranty: In addition to your statutory legal rights, Celtic Pickleball warrants that paddles and products sold will be free from defects in materials and workmanship arising from normal play for a period of sixty (60) days from the date of purchase.

• Exclusions: This warranty does not cover normal wear and tear, cosmetic scuffs or chips from court impact, abuse, negligence, unauthorized alterations, or commercial/institutional use.

• Remedy: If a product is determined to be defective within the 60-day period, Celtic Pickleball will, at its sole discretion, repair or replace the product.

• Statutory Rights Notice: This commercial warranty is offered in addition to, and does not affect or limit, your statutory consumer rights under Irish and European Union law.

 

8. Gift Cards & Vouchers

• Validity Period: In compliance with the Consumer Protection (Gift Vouchers) Act 2019, all gift vouchers purchased from Celtic Pickleball are valid for a minimum of five (5) years from the date of purchase.

• Redemption: Gift vouchers can be redeemed exclusively for eligible goods on the Celtic Pickleball website. They cannot be exchanged for cash, refunded, or used to purchase additional gift vouchers.

• Lost or Stolen Cards: Celtic Pickleball is not responsible for lost, stolen, or unauthorized use of gift vouchers once delivered to the purchaser.

 

9. Limitation of Liability

• To the maximum extent permitted by law, Celtic Pickleball shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products sold.

• Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any statutory rights that cannot be excluded under Irish law.

 

10. Governing Law & Dispute Resolution

• Governing Law: These Terms and Conditions and any contracts formed under them are governed by and construed in accordance with the laws of the Republic of Ireland.

• Jurisdiction: Any legal disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.

• Online Dispute Resolution (ODR): EU consumers may also access the European Commission's Online platform for resolving consumer disputes online at: https://ec.europa.eu/consumers/odr.
